KOHN, Justice. This is an action for damages for personal injuries resulting from a collision between two automobiles. The complaint contained
one count of simple negligence. The jury returned a verdict in favor of defendant, and judgment was rendered thereon in favor
of defendant in accordance with the verdict. Thereafter, the plaintiff made a motion for a new trial which was granted by
the trial court.
